Attorneys generally require an advanced fee (sometimes called a retainer) to be deposited in their trust account. The amount requested by the attorney may range from as little as $3,000.00 to $30,000 or more.

Filing Fees

The first cost in any divorce is the filing fee. In Denton County, the fee to begin a divorce and file an Original Petition for Divorce is currently $350. Additional fees may apply if you’re requesting service of process, need to pay fees for issuing subpoenas, citation, or notices, or other motions.  These fees are set by the Denton County District Clerk’s office and are subject to change.

Mediation is often required by the judges in contested divorce cases in Denton County. A private mediator typically charges $800–$1,500 per party for the mediation.  The cost of mediation will be based on whether or not the mediation is scheduled for a half-day session or full-day session.
